CONTENT CREATOR AGREEMENT

"Creator" means an individual who creates and publishes content on their custom website to be viewed by other users.

Overview

As a Creator on Tushly.com, you agree to the following terms when you verify your account.

Agreement Terms

• Tushly.com prohibits any activity that is illegal or otherwise violates our terms
• Tushly.com requires the Creator to obtain and keep on record written consent from all individuals depicted in any form of content posted on the Tushly.com website swearing consent to:
  • Public sharing of the content and to upload the content to the Tushly.com website
  • Content will be viewable to all subscribers on the Tushly.com website
  • Documentation to prove an age of at least 18 years old with documented evidence such as a valid photo ID.
  • Allow Tushly.com to view and access verification documents

Content Provider Representations, Consent, and Age Verification

By uploading, submitting, streaming, publishing, distributing, or otherwise providing content to Tushly, the Content Provider represents, warrants, and agrees to the following:

Prohibited Content and Activity

The Content Provider will not upload, publish, transmit, stream, distribute, promote, or otherwise engage in any activity or provide any content that is illegal or otherwise violates Tushly's Terms and Conditions, Content Standards, policies, payment processor requirements, or applicable laws and regulations.

Written Consent of All Persons Depicted

Before submitting or uploading any content depicting another person, the Content Provider must obtain and maintain written consent from every person depicted in the content.

Such written consent must specifically include:

• Consent to be depicted in the applicable content.

• Consent to the public distribution of the content and to the uploading, publication, and distribution of the content through Tushly.

• If the content will be made available for download by other users, consent to allow users to download the content.

The Content Provider must retain these written consent records for as long as the applicable content is made available through Tushly and for any additional period required by applicable law.

Identity and Age Verification

The Content Provider must verify the identity and age of every person depicted in submitted content before the content is created, uploaded, submitted, streamed, published, or distributed through Tushly.

The Content Provider must ensure that every person depicted in the content is an adult who is at least 18 years of age and has reached the age of majority applicable to the individual and the jurisdiction in which the content is created.

The Content Provider must obtain and maintain supporting documentation sufficient to verify the identity and age of every person depicted in the content, including valid government-issued identification where required.

Records and Documentation

The Content Provider must maintain accurate records demonstrating compliance with these requirements, including applicable written consent and identity and age-verification documentation.

Upon request by Tushly, the Content Provider must promptly provide supporting documentation demonstrating that all persons depicted in the applicable content provided the required consent and were verified as adults.

Failure or refusal to provide requested documentation, or any violation of these requirements, may result in rejection or removal of content, suspension or termination of the Content Provider's account, withholding of access to platform services as permitted by applicable law and the Agreement, and reporting to appropriate authorities where required.

Contract Termination

On Tushly.com, the contract period will continue as long as the Creator does not close the account.

Confidentiality

This Agreement is strictly confidential and only authorized personnel are allowed to access.

Signature

Anyone who registers as a Creator and confirms their account is considered to have accepted this agreement. If you do not accept the agreement, please close your Creator account or contact support@tushly.com.
